Nothing on the Site grants any license or right to use any TNC mark, and you may not use them in any manner likely to cause confusion, or to disparage or discredit TNC.

Pricing and estimating methodology. The unit rates, cost data, quantity-derivation formulas, measurement conventions, and estimating methodology used by TNC and reflected in the operation of any calculator, estimator, or quoting tool on the Site are confidential and proprietary trade secrets of TNC within the meaning of the Tennessee Uniform Trade Secrets Act and the federal Defend Trade Secrets Act of 2016. They are not published, and they are not made available for use by any third party. Access to a planning range produced by a tool on the Site conveys no right to derive, reconstruct, reproduce, or use the underlying rates or methodology, and any attempt to do so is a misappropriation of trade secrets.

Acceptable Use of the Site and Its Tools

You may use the Site and any estimator, calculator, or form on it for the purpose of evaluating and requesting services from TNC for a project you own or are authorized to act on. You may not:

Access the Site or any of its interfaces, endpoints, or tools by any automated means — including scripts, bots, crawlers, scrapers, headless browsers, or agents — except that a general-purpose search engine may index publicly available pages consistent with our robots.txt;
Submit repeated, automated, systematic, or bulk requests to any estimator, calculator, form, or programmatic interface on the Site, including for the purpose of measuring, sampling, inferring, benchmarking, or reconstructing TNC's rates, costs, formulas, or methodology;
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, rates, or methodology underlying any tool on the Site;
Use the Site, its tools, or any output of them for competitive analysis, price benchmarking, or to build, train, or improve a competing product, service, dataset, or model;
Circumvent, disable, or interfere with any rate limit, bot challenge, authentication, or other security or access-control measure, or take any action that imposes an unreasonable load on our infrastructure;
Remove, obscure, or alter any copyright, trademark, or proprietary notice.

Estimates and Planning Ranges

Any figure, range, or estimate produced by a calculator or estimator on the Site is an approximate planning range for informational purposes only. It is not a quote, a bid, an offer, a firm price, or a contract, and it does not bind TNC in any way.

Such ranges are generated automatically from the limited information you enter, without a site visit, survey, soil or geotechnical investigation, utility location, engineering review, or verification of quantities or conditions. Actual pricing depends on site conditions, access, soil and rock, utilities, water, permits, code and inspection requirements, material availability and cost at time of contract, scheduling, and the final agreed scope of work. Ranges are rounded and approximate by design, and may differ from a written proposal in either direction.

A binding price exists only in a written proposal or contract signed by an authorized representative of TNC. You should not rely on a planning range in making a financial, lending, purchase, or contractual decision.
